NY Attorney General Letitia James Pleads Not Guilty to Federal Bank Fraud Charges

New York Attorney General Letitia James pleaded not guilty Friday morning to federal charges of bank fraud and making false statements to a financial institution, stemming from a 2020 real estate purchase in Virginia.

The arraignment, held at the U.S. District Court in Norfolk, marks the first time the high-profile Democratic official—well known for leading major civil actions against former President Donald Trump and the NRA—has faced criminal prosecution.

Federal prosecutors allege that James misrepresented a property in Norfolk, Virginia, as a “second home” when applying for a mortgage, allowing her to qualify for more favorable loan terms.

The indictment claims she treated the home as an investment property, violating mortgage terms and saving an estimated $19,000 in interest over the life of the loan.

James purchased the home for about $137,000 in 2020, using a $109,600 mortgage, according to court filings.

Speaking briefly outside the courthouse, James called the charges “baseless and politically motivated.”

“This case is not about truth or justice—it’s about retaliation,” James said.

“I have spent my career holding the powerful accountable, and now I am facing retribution for doing my job.”

Her defense team intends to seek dismissal of the indictment, arguing that the interim U.S. Attorney overseeing the prosecution, Lindsey Halligan, was appointed unlawfully.

Legal analysts expect the legitimacy of that appointment to become an early flashpoint in the proceedings.

Federal prosecutors maintain that the case is straightforward and evidence-driven, rejecting claims of political interference.

In a brief statement, the U.S. Attorney’s Office for the Eastern District of Virginia said it would “vigorously pursue justice under the facts and the law.”

James’s indictment has sent shockwaves through New York political circles. As state attorney general, she has been one of the most visible Democratic figures in the country, leading high-profile civil cases—including the one that resulted in a $454 million judgment against Donald Trump earlier this year.

Republican lawmakers have seized on the case, framing it as evidence of hypocrisy, while Democrats have largely rallied behind her, warning against what they call a “dangerous politicization” of the justice system.

The court scheduled pretrial motions for early December. If the case proceeds, trial could begin in mid-2026. Until then, Letitia James remains in office and has vowed to continue her duties as New York’s top law enforcement officer.

“I will not be intimidated or silenced,” James said Friday. “I will keep fighting for the people of New York.”
